Non-Discretionary Bonuses are bonuses paid to employees based on some type of performance metric, attendance, production, or any guarantee for performance where the employee performs or achieves X; and will receive Y for getting there. This type of bonus is one which is promised to the employee, and they can expect this bonus if they follow through on the measureable performance metric or attendance expectation. Because this bonus is based on performance, it must be included in overtime calculations for the weeks it was earned. Failure to include this performance bonus in overtime calculations will result in underpayment of overtime to employees when they worked overtime hours during the non-discretionary bonus achievement period.
