Separation Notice Rules

Here is a copy of the BEN-241 document in case you need to prepare statements for this document should you receive it. You can get to it by CLICKING HERE. Ensure you complete a copy and insert or scan a copy of this into the employees personnel file.

Per Alaska State Law, this notice *must* be given to every employee at the time of separation of employment. To download this flyer, please CLICK HERE.

Arizona employers must provide the separating employee a copy of form UIB-1241A. To download this flyer, please click here. Workforce 2080 used the following website to locate the bills/statues on the final pay rules; you can locate this and other bills by CLICKING HERE.

Arkansas employers must provide the separated employee a copy of Appendix A to Rule 5 upon separation. To download this document, please CLICK HERE.

Employers are legally required to provide the following form to your employees upon separation (Electronic or Hard Copy). To get this form CLICK HERE.

Employers are required to provide employees with a signed and completed unemployment notice (form UC-61) and employee packet "immediately" upon layoff or separation from employment. It must be provided regardless of reason why the employee is separating employment. If the employee is not present, you must mail a copy of it to the last known address on file. Delaware does not have a separation notice that is provided to employees; but their unemployment insurance handbook details documentation and a progressive discipline program to protect your organization as much as possible so you can respond effectively on forms BW-199 and UC-119C. Florida does not have any separation notice requirements per its website as of 2/2/2023 @ 8:49 PM CDT.

Georgia employers are required at the time of separation to provide an employee with the below document which must be completed by you. It will give reasons for separation. This will also serve as documentation in case you receive a request for separation from the state of Georgia. To get a copy of this document CLICK HERE.

Hawaii does not have separation notice requirements per its website as of 2/3/2023 @ 5:51 PM CDT.

Idaho does not have separation notice requirements per its website as of 2/3/2023 @ 6:14 PM CDT.

When workers are laid off from work for more than seven (7) days or separated from the payroll for any reason, employers are *REQUIRED* to provide them with a copy of this publication. If employee is not physically present, you can mail to their last known address within five (5) calendar days of separation. CLICK HERE to get a copy.

According to Indiana Department of Labor's website, there is no separation notice requirement as of 2/3/2023 @ 6:55 PM CDT.

Iowa employers who have an employee who leaves/quits or refuses your employment for any reason which you believe will disqualify them from unemployment insurance benefits, you should notify the Iowa Workforce Development by completing the Notice of Separation (60-0154). You can also file it online by CLICKING HERE.

According to the Kansas Department of Labor's website, there is no separation notice requirement as of 2/3/2023 @ 11:49 PM CDT.

According to the Kentucky Department of Labor's website, there is no separation notice requirement as of 2/4/2023 @ 7:12 AM CDT.

Employers in the state of Louisiana are required to complete a separation notice for a former employee within three (3) days after the date on which the separation from service, or three (3) days after the worker's separation from employment. You will need to submit and file Form 77 online; and can get there by CLICKING HERE.

Employers should give an employee the written reasons of termination of that person's employment upon their written request. An employer who fails to satisfy this request within 15 days of receiving it may be subject to a forfeiture of not less than $50 nor more than $500. Employees may also bring an action in the District Court for such equitable relief. For more information on this rule, please CLICK HERE.

Maryland Department of Labor's Division of Unemployment Insurance is requiring employers to provide a notification to employees at the time the employee separates from employment. This notice will inform the employee of the availability of unemployment insurance compensation. To get this document, CLICK HERE. For the notice detailing this requirement, CLICK HERE.

When an employee is separated from employment, regardless of the circumstance, it is the employers responsibility to issue the employee a copy of the DUA pamphlet on How to File for Unemployment Benefits, form 0590A. The law allows THIRTY-DAYS (30) to distribute this information to all permanently and temporarily separated employees. For a copy of 0590A, CLICK HERE. Employers in Michigan are required to provide each employee, when separated from your employment with a completed copy of fomr UIA 1711 and should receive a completed copy of this form or an equivalent written notice. A $10.00 penalty for non-compliance may be imposed on the employer by UIA. To get a copy of this report, CLICK HERE.

According to the Minnesota Department of Labor's website, no notice of separation is required by law, by either party, upon separation of an employee for any reason. To see more information on this, CLICK HERE.

Mississippi employers can submit Separation information through Mississippi's portal by CLICKING HERE. To visit the webpage prior to submittal, you can CLICK HERE.

Missouri does not have any separation notice requirements, but Missouri Employers are REQUIRED to notify the Family Support Division (Child Support Enforcement) within ten (10) days of terminating an employee under wage withholdings. to fulfill this requirement, an employer may complete and return page 3 of the Income Withholding for Support to the address provided at the bottom of that page or an employer may report terminations online. Montana Department of Labor's website is silent on Separation Notices as of 2/4/2023 @ 9:57 AM CDT.

Nebraska employers need to report terminations through the Nebraska Child Support Payment Center's website, you can submit that information by CLICKING HERE.

Nevada employers are required to provide unemployment claim information to employees at time of separation. You can get this form by CLICKING HERE.

New Hampshire does not have a separation notice distribution requirement, but the state requires by law that New Hampshire Employers post an unemployment notice in a conspicuous place. To get a copy of this notice, please CLICK HERE.

New Jersey does not have a separation notice distribution requirement, but the state has a website with forms for responding to agencies for separation information. To see these forms, CLICK HERE.

The New Mexico Department of Labor's website does not disclose of any separation notice requirement as of 2/5/2023 @ 2:45 PM CDT.

New York Employers are required to notify an employe who has been terminated from employment, in writing, of the exact date of such termination as well as the exact date of cancellation of employee benefits connected such termination. North Carolina Employers who have employee who is no longer employed with them will need to complete the Separation of Employment Notification (Form NC-SEP) to notify the Department that an employee for which they were served a garnishment on is no longer employed. Employers in North Dakota shall instruct workers who are separated from employment (permanently or for an indefinite period or for an expected duration of seven (7) or more days) to report promptly (either in person or by mail) to the public employment service office most convenient to the worker. The Ohio Department of Labor does not have any formal documentation or directives to issue a separation notice on their website as of 2/5/2023 @ 5:06 PM CDT.

The Oklahoma Department of Labor does not have any formal documentation or directives to issue a separation notice to employees on their website, but they do have specific ways employers must respond when information is requested after an employee files a claim. The Oregon Department of Labor does not have any formal documentation or directives to issue a separation notice to employees on their website as of 2/5/2023 @ 5:57 PM CDT. CLICK HERE to view the site regarding employment at will.

Pennsylvania Employers are required to provide a completed form to separating employees. To get a copy of this document, please CLICK HERE.

All Rhode Island employers must provide a separating employee a notice of unemployment compensation at the time of separation from employment. Employers may (but are not required) to use the sample language to supply the content on the notice to the separating employee. To view this document, please CLICK HERE.

South Carolina employers must provide the below document to an employee upon separation from employment. The notice may be provided in hard-copy, in person, mail, or electronically by email or text message. CLICK HERE to see this document.

The South Dakota Department of Labor does not have any formal documentation or directives to issue a separation notice on their website as 2/6/2023 @ 7:04 PM CDT.

Tennessee Employers must within twenty-four (24) hours of the time of separation, the employer is required by Rule 0800-09-01-.02 of Tennessee Employment Security Law to provide the employee with the below document, properly executed, giving the reasons for separation. Texas employers do not have any separation notice issuance directives, however, the employer is directed by the Texas Workforce Commission to follow specific rules when replying back to a Notice of Application for Unemployment Benefits. You can find these stipulations by CLICKING HERE.

Utah employers do not have to provide a formal separation notice; however, employees are directed by the Utah document in this section to request information as to the reasons for their separation. They don't need a separation notice to file a claim for unemployment. Both the employee and the employer will be requested to provide statements explaining the reason for the employees separation. Vermont employers are not required to issue a separation notice to departing employees, however, the Vermont Department of Labor has specific rules surrounding replying back to employees claims for unemployment which result in separation forms being mailed to the employer to reply back. Virginia employers are not required to issue a separation notice to departing employees, however, the Virginia Employment Commission Employer's Report of Separation and Wage Information shows the exact information you will be required to complete if the employee files a claim for unemployment insurance and named you (the employer). Washington employers are not required to issue a separation notice to departing employees, however, the Washington Employment Security Department provides guidance on how to reply to a Request for Separation Information (RSI). To view that information, please CLICK HERE.

The West Virginia Department of Labor does not have any stipulations or requirements for distribution of a separation notice to departing employees on their website as of 2/6/2023 @ 8:26 PM CDT.

Wisconsin employers do not have to provide a separation notice upon an employees termination, but employers are required to display Wisconsin's Unemployment Insurance posters in each workplace (where employees will readily see them). To locate these posters, please CLICK HERE.

The Wyoming Department of Labor does not have any stipulations or requirements for distribution of a separation notice to departing employees on their website as of 2/6/2023 @ 8:42 PM CDT.

Ensure employees timesheet has been completed with any missing punches, paid time off requests approved, and any final earnings added to the timecard which may be due.




Paid Time Off - Sick - Vacation

Pay out Paid Time Off, Sick, or Vacation Balances.


How much Paid Time Off, Sick, or Vacation is owed to the employee?




Insurance Premiums and other Deductions

Collect final Insurance Premiums or Refund Insurance Premiums back to employee so they can be taxed.




COBRA Distribution

Was the employees termination due to gross misconduct?

You are not obligated to offer COBRA to this employee. However, the term gross misconduct is narrowly defined by the Department of Labor. You can see their definition by clicking here.


You need to print the COBRA package and distribute to the employee either in person, or mail it to their home address


Employee Mailing Address

Collect the employees physical mailing address and advise them that all COBRA paperwork and W2's will be mailed to that address. All address changes should be directed to your office.

  • Parking Lot Security Badge In.
  • Doors and Entrances.
  • Additional Facilities with Access
  • Access from company programs where employees can make changes (all except for employee profile).
  • Email Access.
  • Company Telephone Access.
  • Remove from Email and Telephone Directory.
